§ 2-70. Council not to interfere with appointments or removals.

Neither councilmembers nor the mayor shall interfere in the city administrator's recommendation
process for the appointment, suspension, or removal of a municipal officer or employee.
However all recommendations for appointment, suspension, or removal of a municipal
officer or employee must be approved by the city council. Except for the purpose of
inquiry, the council and its members shall deal with the city staff solely through
the city administrator and neither the council nor any member thereof shall give orders
to any subordinates of the city administrator, either publicly or privately. Nothing
in this section interferes with the authority of the mayor to appoint municipal officers
if a vacancy exists, pending approval by the city council, pursuant to V.T.C.A., Local
Government Code § 22.010. Nor does this section interfere with the role of the mayor
and/or city council to determine the selection process of municipal officers.
